Minutes of Conservation Commission Public Meeting

Location:       Wellfleet Senior Center

Commissioners Present:  Co-Chair Ginie Page, Co-Chair John DiBlasio, Dottie Dolan, Cyndi Moe, and Ed Reynolds.  Paul Banner arrived late to the meeting.

Staff Present:  Hillary Greenberg, Conservation Agent and Christine Bates, Committee Secretary

Meeting called to order at 4:00 P.M. by Co-Chair Ginie Page

Business Meeting:

Ginie Page reported she was alerted to a possible change to the wooden bulk head on Donald’s property located on Old Wharf Road which was not identified on the approved plan.

The Commission edited the letter to be sent to abutters of Conservation land.  John DiBlasio moved to accept recommended changes and have Christine Bates retype letter along with rules and regulations; seconded by Ed Reynolds; passed 5-0.

Cyndi Moe moved to approve the March 1, 2006 meeting minutes as amended; seconded by Dottie Dolan; passed 5-0.

Agent Greenberg read the definition of a subdivision for the Commissioners.

Correspondence

Agent Greenberg advised the Commission a representative from Town Counsel will be making a presentation on legal matters March 28, 2006 at 1-3 pm and 3-5 pm.

Jim O’Connell will be at the Pearson property on March 21, 2006.


Greenberg advised the Commission of various training opportunities available.  

A discussion took place regarding the signs at 1440 Chequessett Neck Road regarding private property.  Cyndi Moe states the driveway is on town property and logs are placed on town property and access area.  Ginie Page concerned the telephone poles deny access for turtles.  Agent Greenberg will discuss with DPW.

David LaJoie asked the Commission what their concern was regarding the Boriskin property on Commercial Street.  The Commission stated they would like to have LaJoie review the structures size against the plans submitted.

Public Hearings:

Bliss, Michael, 20 Lil’s Way, Map 29, Parcel 253:  Extension Permit for Order of Conditions.  Agent Greenberg stated the Bliss’ need additional time for tree maintenance and planting.  They requested a three year extension.  Cyndi Moe moved to grant the extension of the Order of Conditions; seconded by Ed Reynolds; passed 5-0.

Kugell, Stanley, 6 Way #14, Map 9, Parcel 628:  RDA, septic system upgrade.  A site visit was made.  David LaJoie represented the applicant.  Agent Greenberg had sent the applicant several letters regarding the failure of the cesspool.  LaJoie stated the applicant needs to go to the Board of Health for variances.  Dottie Dolan moved to identify this project as a Negative 3; seconded by Ed Reynolds; passed 5-0 with the condition a silt fence be installed along the work limit.  

Ziering, Ira, 115 Way #89, Map 29, Parcel 285:  NOI, Construction of addition to existing dwelling and septic system upgrade within 50 foot filter strip and 100 foot buffer zone.  Cyndi Moe recused herself.  A letter from Felco Inc. dated March 13, 2006 requested a continuation to April 5, 2006. Ed Reynolds moved to continue the hearing to April 5, 2006; seconded by Dottie Dolan; passed 5-0.

Elliott, Darryl, 3B Indian Neck Road, Map 28, Parcel 231:  NOI, demolish cottage and construct new dwelling (Cont’d from 2/15/06).  Neither the applicant nor the representative appeared at the hearing; nor did the applicant contact the Conservation Agent regarding a continuation.  It was determined the paperwork was incomplete.  Cyndi Moe moved to continue the case indefinitely and refile.  Cyndi Moe rescinded her original motion and moved to deny the Elliott application; seconded by Dottie Dolan; passed 6-0.  (Paul Banner arrived at meeting at 5:15 pm).  The reason for the denial:
1.      Paperwork inadequate.
2.      No contact from applicant or representative.
3.      The local regulations were not addressed.
4.      Neither the applicant nor the representative paid the local filing fees.  
Agent Greenberg will send a letter and copy DEP and Natural Heritage.  The applicant will be required to refile.

Matson, Peter & Susan, 2950 Old Kings Hwy, Map 3, Parcel 2:  NOI, Septic System Upgrade.  Due to the lack of a DEP number, Ed Reynolds moved to continue to the hearing to April 5, 2006; seconded by Cyndi Moe; passed 6-0.

Kerr, Edwin, 615 Chequessett Neck Road, Map 19, Parcel 118:  NOI, temporary access for septic system installation at 599 Chequessett Neck Rd.  Due to the lack of a DEP number, Cyndi Moe moved to continue to April 5, 2006; seconded by Ed Reynolds; passed 6-0.

McNamara, William, 349 Old Kings Highway, Map 23, Parcel 71:  NOI, septic system upgrade and new well installation.  Due to a lack of a DEP number, Ed Reynolds moved to continue to April 5, 2006; seconded by Dottie Dolan; passed 6-0.

Granville, Robert, 46 Eric’s Way, Map 8, Parcel 67:  NOI, construction of dwelling within 100 foot buffer zone.  Due to a lack of a DEP number, Cyndi Moe moved to continue to April 5, 2006; seconded by Dottie Dolan; passed 6-0.

Cyndi Moe reported all changes in ownership of property will require carbon monoxide devices be installed by April 1, 2006.

Agent Greenberg reported Amnesty Day is scheduled for April 8, 2006 at the Land Fill.

Dottie Dolan moved to adjourn the meeting at 5:37 pm; seconded by Cyndi Moe; passed 6-0.
